THIS IS A CASE THAT DIRECTLY INVOLVES TVOTW & THE GLOBAL FUND & TVOTW CAN SPEAK ON THE MATTER FROM PERSONAL FIRST HAND KNOWLEDGE.
THE PERPETRATORS HAVE BEEN PUT ON NOTICE - THE PERPETRATORS CLAIM ON TAPE - QUOTE - "THEY DON'T CARE" - IF WE HAVE INDICTMENTS ISSUED BY THE POLICE OR CRIMINAL INVESTIGATION BUREAU.
QUOTE -- "THEY DON'T CARE HOW MUCH THE LEGAL COSTS ARE" -- "EVEN IF THOSE COSTS RUN UP TO A MILLION DOLLARS".
In the early hours of Sunday 16th June 2019 - officials of The Global Fund placed an order for a Samsung Galaxy S10 5G mobile handset on eBay. The eBay item number was - 303182505580. A screen dump of the item is included here.
What is even more disturbing - NOW - when this eBay item number - 303182505580 - is opened in a browser - changes and alterations to the original listing have been made - including the listed price - (now A$1,699.00) - AND - the line in the second item description line - now contains no reference to the discount of 15% as delineated in the first screen dump above. In other words - many days AFTER - the sale was completed for this item number - the seller has come in and deliberately - and fraudulently changed the content for this listing for the purpose of misleading any examination of the facts in relation to this item - as they applied at the time of the completion of the sale. This screen dump - shows the sub title (or second item description line) - changed on 28th June 2019 - 12 days after the completion of the sale. The 66,000 question - why change the content - and particulars - of a listing - long since completed and finalized???
You will note that on the second item description line (or subtitle line) - appears the following claim - "15% off with code PMOBILE15, ends 17/06, ebay T&C Apply". The item is listed for A$1,599.00. 15% of A$1,599.00 is - $239.85. The nett amount to be paid at checkout - if purchased before the close of business on 17th June 2019 - is A$1,359.15. The eBay advert also alleged that this was the last phone available at this price. The phone was brand new.
Further down in the eBay advert for this item was another box. At the start of the line is a green dollar sign followed by the text - "Pay only AU$1,519.05 Show me how" - with an underlined link. When you move the mouse over the link - another box opens up which says - "Buy it now price AU$1,599.00 - AU$79.95 Your price $1,519.05. A promotional code - this time - "PLANET" - needed to be used.
It was determined that if by using the promotional code at the top - the price would be reduced to - A$1,359.15 - that was - by far - the most preferable option to take.
The writer applied the discount promotional code of "PMOBILE15" many times. It did not work. After many attempts it was impossible to alter - or reduce - the amount being requested at check-out. Because it was approximately 3:00am on a Sunday morning - it was felt that the best course of action was to pay the full amount of A$1,599.00 - and have eBay fix it during business hours on Monday morning.
On Monday - eBay Customer Support was contacted. The consultant claimed that the first offer mentioned on the second description line was - at no time - an offer from eBay. It was included in that box by the seller - "cellonline" - and had nothing to do with eBay. We should contact the seller to have that refund made. The consultant also referred us to the official eBay promotional offer further down - next to the green dollar sign. After being asked - "why would we pay A$1,519.00" - when we could buy it for the lesser amount of - A$1,359.15? The consultant said again - "you need to have the seller take care of that refund - the shop "cellonline" - are the ones responsible for that offer and shown as such - in the second item description or - (sub title) line."
We have since contacted the seller many times asking for the refund to be applied. THEY REFUSE. They claim that they have spoken to eBay and allegedly - eBay have said - "you are right - ignore the customer - tell the customer to call us."
We have spoken to eBay many times to get this matter resolved. eBay repeats what they have already told us on previous occasions. "The seller knows very well they are responsible for all statements and claims contained in an eBay advertisement." "The seller is the only party who can make good this refund."
We have contacted the seller after eBay suggested cancelling the transaction - and putting the sale through again for the lesser amount of A$1,359.15. The seller refuses to cancel the sale and refund the money so that we can put the sale through again. The seller claims that in that circumstance we could keep the refunded A$1,599.00 - and keep the phone as well - without paying for it. When we say - but we paid you - in good faith - and in advance - relying upon your integrity to post the phone to us. Now - we are doing the same thing - and you say you cannot trust us - or risk the possibility of refunding the cost - and having us NOT return the phone - and NOT rebuying it as well.
We have contacted the Queensland Department of Consumer Affairs. They have told us the Department will investigate the matter and if the facts support it - the equivalent of the CIB will be asked to prepare indictments.
FACT 1 - IT IS CLEAR THE OFFER WAS INCLUDED IN THE EBAY ADVERTISEMENT AS AN INDUCEMENT TO BUY THE ITEM.
FACT 2 - IT IS CLEAR THE SELLER - "CELLONLINE" - HAD SOUGHT TO OBTAIN A PRICE OF A$1,599.00 WHILST CONTEMPORANEOUSLY - AND - FALSELY CLAIMING TO APPLY A PROMOTIONAL DISCOUNT OF A$239.85 - WHICH WAS AT NO TIME TRUE.
FACT 3 - FURTHERMORE - THE SELLER FALSELY CLAIMS THAT THE PROMOTIONAL DISCOUNT REPRESENTS AN OFFER BY EBAY. THE BUYER SHOULD SEEK REDRESS FROM EBAY.
FACT 4 - THE SELLER HAS ADMITTED WHILST BEING RECORDED OVER THE PHONE - THAT THIS HAS HAPPENED MANY TIMES BEFORE WITH OTHER EBAY MEMBERS. IN OTHER WORDS - THIS SCAM IS - AND - HAS BEEN PROSECUTED FOR SOME TIME. DUE TO THE AMOUNT OF COMMERCE NOW TAKING PLACE ON THE INTERNET GLOBALLY - THIS REPRESENTS MASS MARKETING FRAUD AND ELECTRONIC WIRE FRAUD ON A MASSIVE SCALE. IT IS MASS MARKETING FRAUD THAT IS TOTALLY OUT OF CONTROL - AND - IS SOMETHING BEYOND THE ABILITY AND RESOURCES OF THE AVERAGE PERSON TO POLICE - PROSECUTE - OR PREVENT. EBAY ARE TAKING NO MEASURES WHATSOEVER TO PREVENT IT - OR TO SEE JUSTICE DONE.
FACT 5 - THE SELLER HAS MADE SUBSTANTIVE CHANGES TO THE CONTENT AND TERMS OF THE ORIGINAL TEXT FOR THIS EBAY ITEM NUMBER -12 DAYS AFTER THE COMPLETION AND FINALIZATION OF THE SALE. THE EBAY LISTING SETTING OUT THE DESCRIPTION AND TERMS AT THE TIME OF SALE REPRESENTS A LEGALLY BINDING CONTRACT (IN THOSE TERMS) - AND AS SUCH - IS RELIED UPON BY THE PURCHASER OF THE GOODS AS HIS CONTRACT OF SALE. WHY CHANGE THOSE TERMS AND CONDITIONS AFTER THE SALE - UNLESS IT BE FOR AN ULTERIOR MOTIVE ???
FRAUD ON EBAY IS ENDEMIC. MORE THAN 10 YEARS AGO - A MEMBER OF THE GLOBAL FUND SOLD A VERY EXPENSIVE TOSHIBA PDA ON EBAY TO A MEMBER IN INDIA. THE ITEM WAS PAID FOR ON PAY PAL. TO ADD TO THE COMPLICITY OF EBAY - WHO OWN PAY PAL - THE FOLLOWING TOOK PLACE.
AFTER SHIPPING THIS VERY VALUABLE ITEM - WORTH MORE THAN A$1,000.00 AT THE TIME - AND AFTER SENDING THE TRACKING DETAILS TO THE FRAUDSTER PURCHASER - 3 DAYS LATER - ADVICE WAS RECEIVED FROM PAYPAL THAT THEY WERE CANCELLING THE PAY PAL TRANSACTION.
TO THIS VERY DAY IN JULY 2019 - THE GLOBAL FUND HAS NEVER SEEN ANYTHING OF THE FOLLOWING:-
NONE OF THE FUNDS TAKEN BACK BY PAY PAL - AND - NEVER SEEN ANYTHING MORE OF THE ITEM ITSELF - WHICH THE POST OFFICE REFUSED TO RETRIEVE.
FURTHERMORE - AND TO FURTHER EXACERBATE THIS NIGHTMARE - EBAY WILL NOT ALLOW EBAY SELLERS TO REFUSE TO ACCEPT PAY PAL AS A PAYMENT METHOD.
